Participation Agreement & Release

In consideration of being permitted to participate in youth sports, adult sports and leagues, fitness activities, gym and membership participation, practices, games, tournaments, camps, clinics, training sessions, classes, and other programs and activities organized, sponsored, or administered by the Cheyenne County Community Center (“The Center”), I acknowledge and agree as follows. Adult participants accept this Agreement for themselves; when the participant is a minor, a parent or legal guardian accepts it on the participant’s behalf. This Agreement applies Center-wide to both adults and minors, with the parent/guardian and concussion provisions applying only where relevant to a minor participant.

1. Acknowledgment of Risks

I understand that participation in sports, fitness, gym and other physical activities involves inherent and other risks. These may include, without limitation, running, jumping, physical exertion, use of cardio and strength equipment, free weights, falls, slips, collisions, contact with other participants, spectators or objects, playing surfaces, weather conditions, equipment use or failure, acts of other participants, and other hazards associated with athletic activity. Injuries may include sprains, strains, fractures, cuts, dental or eye injuries, concussion or other brain injury, illness, permanent disability, paralysis, or death. I understand that rules, supervision, equipment, and reasonable safety measures cannot eliminate all risks.

2. Assumption of Risk

I knowingly and voluntarily accept and assume the risks associated with the participant’s presence at and participation in covered activities, whether known or unknown, to the fullest extent permitted by Nebraska law.

3. Participant Health, Safety & Conduct

I represent that the participant is able to participate subject to any restrictions or accommodations communicated to The Center, and I understand that consulting a physician before beginning or increasing physical activity is recommended. The participant agrees to follow applicable rules and reasonable instructions from The Center staff, coaches, officials, volunteers, and facility personnel; to use equipment appropriately; and to report an injury, illness, unsafe condition, or suspected concussion as soon as reasonably possible. The Center may restrict or remove a participant from an activity when reasonably necessary for safety, conduct, rule compliance, or suspected injury.

4. Release of Liability

TO THE FULLEST EXTENT PERMITTED BY NEBRASKA LAW, I RELEASE AND DISCHARGE THE CHEYENNE COUNTY COMMUNITY CENTER, ITS FOUNDATION, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, COACHES, OFFICIALS, EVENT STAFF, AGENTS, SPONSORS, AND THE OWNERS OR OPERATORS OF FACILITIES USED FOR COVERED ACTIVITIES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM THE PARTICIPANT’S PRESENCE AT OR PARTICIPATION IN COVERED ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

This release does not apply to conduct or liability that cannot lawfully be released or limited under Nebraska law.

5. Covered Activities & Locations

This Agreement applies Center-wide to The Center-organized, sponsored, or administered youth sports, adult sports and leagues, fitness classes and training, gym and membership use, practices, games, tournaments, camps, clinics, and other programs and activities. It applies whether activities occur at the Cheyenne County Community Center, The Training Room, schools, parks, athletic fields, gyms, trails, courts, or other facilities approved or used by The Center.

6. Emergency Medical Authorization

If the participant becomes ill or injured and the participant, or the parent or legal guardian of a minor participant, cannot be reached promptly or is unable to consent, I authorize The Center’s staff, coaches, volunteers, facility personnel, or emergency responders to obtain or arrange reasonably necessary emergency evaluation, first aid, transportation, or medical treatment. I understand that The Center does not guarantee the availability of medical personnel and that I am responsible for medical expenses incurred on behalf of the participant, except to the extent otherwise required by law.

7. Concussion & Brain Injury Acknowledgment (Athletic Activities)

For sports and other athletic activities, I acknowledge that I have received or been provided access to information regarding concussions and brain injuries, including signs and symptoms, risks, and appropriate actions following a suspected concussion. I understand that a participant reasonably suspected of sustaining a concussion or brain injury must be removed from participation and may not return to supervised athletic activity involving physical exertion until the requirements of Nebraska’s Concussion Awareness Act have been satisfied, including required medical evaluation, written clearance, and parent or guardian permission when applicable.

8. Personal Property

The participant is responsible for personal belongings and athletic equipment brought to an activity. To the fullest extent permitted by law, The Center is not responsible for loss, theft, or damage to personal property.

9. Parent / Legal Guardian Consent (Minor Participants)

This section applies only when the participant is a minor. If the participant is a minor, I certify that I am the participant’s parent or legal guardian or otherwise have legal authority to provide this consent. I consent to the participant’s participation in the covered activities, acknowledge the risks described above, and agree to the terms of this Agreement for myself and, to the extent permitted by Nebraska law, on behalf of the participant.

10. Agreement, Severability & Electronic Acceptance

I have had the opportunity to read this Agreement before signing and understand that it affects legal rights. If any provision is found unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by law. A valid electronic acceptance or electronic signature may be treated as an original signature. This Agreement is governed by Nebraska law.

BY ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS AGREEMENT, INCLUDING THE ASSUMPTION OF RISK AND RELEASE OF LIABILITY, AND I ACCEPT IT VOLUNTARILY.
